Can a DWI Affect Your Driver's License Before the Criminal Case Ends?

Can a DWI Affect Your Driver's License Before the Criminal Case Ends?

Most people assume they keep their license until — and unless — they are convicted. In New York DWI cases, that assumption is wrong. Your license can be suspended at your very first court appearance, long before the case is decided.

Suspension Pending Prosecution

Under New York's 'suspension pending prosecution' law, the judge at your arraignment must suspend your license if the accusatory paperwork shows a BAC of .08 or higher. This is not a punishment — it happens automatically, before any trial, any plea, any finding of guilt. For many people, it is the most disruptive part of the entire case: suddenly you cannot drive to work, to school, or to care for your family.

The Hardship Privilege

If your license is suspended at arraignment, you can request a hardship hearing within a short window. At that hearing, you must prove 'extreme hardship' — essentially, that you have no other reasonable way to get to work, school, or necessary medical care. If the court grants it, you receive a limited privilege to drive for those specific purposes only.

Hardship hearings are won or lost on preparation: documentation of your work schedule, proof that public transportation is not a realistic option, and testimony that holds up. This is one of the first things we handle for DWI clients.

The DMV Track Runs Separately

If you refused the chemical test, a separate DMV proceeding can revoke your license for a year — even if the criminal case is later dismissed. And if you are convicted, the DMV imposes its own consequences on top of the court's sentence: revocation periods, the Impaired Driver Program, conditional licenses, and ignition interlock requirements.

What You Can Do

Act early. The hardship hearing window is short, and the DMV deadlines are unforgiving. An attorney who handles both the criminal case and the license side — together — can often keep you driving in some form while the case proceeds.

Garbett Law handles DWI cases across Rockland and Orange County, including the license consequences that come with them. Call (845) 290-2492 — lines are answered 24/7. Se habla español.
