Speeding (VTL 1180)

Speeding is the most common traffic ticket in the Hudson Valley. Points rise with the amount over the limit: three points for eleven to fifteen miles per hour over, four for sixteen to twenty, five for twenty-one to twenty-five, and six for twenty-six or more — which also carries up to thirty days in jail.

What the prosecutor must prove

  • You were the operator of the vehicle.
  • The vehicle was traveling faster than the lawful speed for that road.

Defenses that commonly apply

  • The officer's speed estimate is not reliable.
  • The radar or laser device was not properly calibrated or operated.
  • The signage for the posted limit was not lawful or not visible.
  • The identification of the vehicle or driver is wrong.

Penalties and collateral consequences

A Traffic infraction carries a maximum sentence of no jail and a fine of up to Up to $200 for a first offense, plus a surcharge.

Twelve points in eighteen months triggers a point accumulation hearing, and a suspension can follow even without a DWI. A not-guilty plea at arraignment preserves the chance to contest the ticket.
